The Constitutional Court has adopted Conclusion No. 06, dated June 6, 2025, determining that “Article Sixteen, Clause 3 of the Constitution of Mongolia—pertaining to the right to acquire and own real estate fairly—has been infringed.” This determination is based on the following: The Mongolian Parliament enacted Article 9.3 of the Law on State Registration of Property Rights, which stipulates that, except as provided in Article 9.1.5, the prices referred to in Articles 9.1.3 and 9.1.4 must not be registered at an amount lower than the most recently recorded price. Additionally, Article 1, Section 2 of the Mongolian Constitution states that "the rule of law is the fundamental principle of state activity," while Article 5, Section 3 establishes that "the rights of property owners may be restricted only on grounds specified in law."
